Iván Poklepovic is part of the Environmental and Regulatory practice of Arteaga Gorziglia & Compañía. He has a large experience in environmental lawsuits and administrative proceedings. Of particular note is his involvement in many liability suits for environmental damages and administrative proceedings in which sanctions were involved. He is also well versed in the environmental regulations applicable to investment projects.

He was head of the Environmental Unit of the National Defense Council of Chile from its creation for more than 10 years. There, he implemented and developed the environmental liability system under Environmental Framework Law 19.300. He also worked on matters relating to compliance with environmental laws in the Environmental Compliance Office of the U.S. Environmental Protection Agency (EPA) in Washington D.C.

He has participated before the ordinary and superior courts of justice in environmental lawsuits dealing with damages to forest and water resources, the land, cultural heritage, biodiversity, public property and ecosystems in general. He has also participated in administrative proceedings involving sanitation and other claims.

Mr. Poklepovic has also stood out in helping to prevent environmental litigation. He has negotiated settlements in environmental lawsuits and solved environmental disputes out of court. While he was with the National Defense Council, he defended government agencies sued for environmental damages and tort liability in general.

He has been actively involved in implementing the Environmental Agreement under the Free-Trade Treaty between Chile and the U.S.A., especially in holding the first joint seminar for Chilean and American civil servants on compliance with environmental laws. Another important achievement was conducting a workshop on environmental issues oriented towards Chilean judges.

He is member of the Environmental Law Association and of the Environmental Law Society.

Master of Environmental Law (LL.M.), Pace University, NY, U.S.A. (2004) (under a Fulbright Scholarship awarded in 2003). Diploma in Environmental Law Universidad de Chile (2002).
